Introduction

The terms “I,” “me,” and “my” refer to Monika de Neef – Authentic in Business (“the Owner” respectively “AIB”). These Terms and Conditions also applied on anything created by its former business name ‘True Connections Branding’.

The term the “Site” refers to https://monikadeneef.com and other related websites such as the course platform.

The terms “user,” “you,” and “your” refer to site visitors, customers, and any other users of my Site.

My website sells professional sessions, products, courses, programmes, and projects, and offers free resources such as a blog, audio recordings, PDF downloads, design assets, and more. (the “Service”).

By using https://monikadeneef.com and related websites such as the course platform (this “Site”),  including all materials presented herein, or purchasing any sessions, products, courses, programmes, or projects (“the Service”), or by clicking to accept or agree to the Terms and Conditions when this option is made available to you, you accept and consent to the terms and conditions outlined below, which applies to all visitors, customers, and all other users of the site, and acknowledge reading them.

If you do not want to agree to these terms and conditions, you must not access or use the website.

The materials appearing on this Site are provided as information about Authentic in Business, its Service, and as a platform for making online connections.

1 – The Service

On this Site you’ll have the opportunity to purchase any sessions, products, courses, programmes, or projects, either on a sales pages or by requesting a customised proposal. The pricing and what you’ll get is mentioned in detail, either on the sales pages or in the proposal.

2 – Trademark & Copyright

This Site and Service contain intellectual property owned by Authentic in Business, including but not limited to logos, trademarks, copyrights, proprietary information, download materials, and other intellectual property.

All materials created by Authentic in Business on this Site are protected by New Zealand copyright laws as original works.

The absence of a registered copyright symbol does not mean that such materials are not protected as belonging to Authenti in Business. The contents of this Site are all copyrighted by Authentic in Business, unless otherwise noted.

You must obtain written permission from Authentic in Business to use any intellectual property and to use the contents of the Site in any manner not authorised by these Terms and Conditions.

 

3 – Use Licence

My copyrighted and original materials are provided to you as part of the Service for your individual use only and a single-user licence. No licence to sell or distribute our materials is granted or implied.

If Authentic in Business has materials on the Site which you can download or use online, permission is granted to view and download copies of the materials for personal, non-commercial viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

a. Modify or copy the materials;

b. Post excerpts of material on any social media, blogging about the material, or in any other way that would reasonably appear to share the Site or Service’s information with a non-client;

c. Use the materials for any commercial purpose or for any commercial or non-commercial public display;

d. Transfer the materials to another person  who has not paid for the Service, or “mirror” the materials on any other server.

I reserve the right to immediately remove you from the Service, without refund, if you are caught violating any of these restrictions.

In that case, the licence shall automatically be terminated by Authentic in Business at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

 

4 – Links to Third Party Websites

This Site may contain links to third party websites. All such linked sites, materials and pages are not under the control of Authentic in Business and Authentic in Business is not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any third party website. Authentic in Business refers to the privacy and cookies policy, and terms and conditions of those linked sites, and accepts no liability for any errors or omissions contained in third party websites. These links are provided to improve your use of this Site, enable you to connect with Authentic in Business on various platforms, help Authentic in Business offer the most relevant services for you and conduct sales transactions. Any affiliate links of which Authentic in Business will benefit from will be mentioned on this Site for full transparency, honesty, and clarity.

 

5 – Community Guidelines

Comments about our articles or your opinions on this Site and/or on any social media channel are allowed under the following guidelines:

a. You will not post comments or refer to any content elsewhere on this Site or any social media channel either publicly or privately that infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity; or is defamatory, libelous, indecent, obscene, pornographic, sexually explicit, invasive of another’s privacy, promotes violence, contains hate speech (i.e., speech that attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and/or sexual orientation/gender identity); or speech that could cause emotional harm to fellow community members on the basis of race or ethnic origin, religion, disability, gender, age, veteran status, and/or sexual orientation/gender identity); or discloses any sensitive information about another person, including that person’s email address, postal address, phone number, credit card information, or any similar information;

b. You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;

c. You will not “stalk,” threaten, or otherwise harass Authentic in Business, its owner nor another person in the community;

d. You will not spam or use the Site to engage in any commercial activities;

e. You will not access or use the Site to collect any market research for a competing business;

f. You will not interfere with or attempt to interrupt the proper operation of the Site through the use of any virus, device, information collection or transmission mechanism, software or routine, or access or attempt to gain access to any data, files, or passwords related to the Site through hacking, password or data mining, or any other means;

g. You will not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission; provided, however, we grant the operators of public search engines permission to use spiders to copy materials from the public portions of the Site for the sole purpose of and solely to the extent necessary for creating publicly-available searchable indices of the materials, but not caches or archives of such materials; and

h. You will not take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our technical infrastructure.

I reserve the right, in my sole and absolute discretion, to deny you access to the Site, or any portion of the Site, without notice, and to remove any content that does not adhere to these Community Guidelines.

What I share is the opinion and perspective of Authentic in Business. The information and education is not intended or implied to supplement or replace professional advice. Before taking any action, please make sure you consult with a professional.

I make no guarantees about any particular results or benefits that you’ll get from my Site, my products or services, mentioned by me or in testimonials. I will do everything to give you the tools to succeed, but I make no guarantees. I cannot be any more clear about this: I make no promises regarding results and make no guarantees whatsoever. 8 – Payments

The purchase price or enrolment price is either mentioned on the Sales Pages on this Site or in the customised proposal sent to you directly.

All payments made by you to Authentic in Business are subject to Authentic in Business’s Terms and Conditions, Privacy & Cookies Policy, and Earnings & Testimonials Disclaimer.

9 – Acceptance of Service

The Services are offered subject to AIB’s acceptance of your order or requests. No order is deemed accepted by AIB until payment has been processed. AIB may at any time change or discontinue any aspect or feature of the Site or Service, subject to fulfilling AIB’s previous responsibilities to you based on acceptance of your payment.

 

10 – Order confirmation

AIB will email you to confirm the placement of your order and with details concerning delivery of the Service. In the event that there is an error in this email confirmation, it is your responsibility to inform AIB as soon as possible by sending an email to support [at] monikadeneef [dot] com.

 

11 – Refusal of Service

AIB reserves the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. If payment(s) have been made, AIB will refund the payment.

 

12- Account creation

In order to use the Service, you may be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to Monika de Neef – Authentic in Business will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction. Clause 5 of these Terms and Conditions apply here as well.

 

 13 – Refunds

AIB’s Payment & Refund policy for the Services sold on this Site or any other site owned by AIB is mentioned on the sales pages on the sites or in the customised proposal.

14 – Limitation of Liability

The owner of this Site, Authentic in Business and its founder/director assume no responsibility or liability for any consequence resulting directly or indirectly from any action or inaction you take based on the information found on the Site or material linked to this Site, or any other site owned by AIB.

In no event shall Authentic in Business or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if Authentic in Business has been notified orally or in writing of the possibility of such damage.

 

15 – Indemnity

As a condition of your use of this Site, or other sites owned by AIB, you indemnify Authentic in Business and its owner and affiliates from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting or arising from your use of AIB’s Sites.

 

16 – Choice of Laws and Venue

The parties agree to irrevocably submit all claims relating to Authentic in Business’s Sites to the exclusive jurisdiction of the courts of New Zealand without regard to its conflict of law provisions.

 

 17 – Entire Agreement and Amendments

These Terms and Conditions and any other legal notices, policies and guidelines of Authentic in Business linked to these Terms and Conditions or contained on this Site and other sites owned by AIB, constitute the entire agreement between you and Authentic in Business relating to your use of the Sites and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter.

Authentic in Business may revise, modify, amend, supplement and replace these Terms and Conditions at any time without providing you with advance notice. Your continued use of the Sites after any change means you have accepted the changed Terms and Conditions.

This Agreement may not be amended or modified except by Authentic in Business. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, that portion or provision shall be enforced to the maximum extent permissible so as to effectuate the intent of the parties as reflected by that provision, and the remainder of these Terms and Conditions shall continue in full force and effect. Failure by Authentic in Business to enforce or exercise any provision of these Terms and Conditions shall not constitute a waiver of that right. Paragraph headings are for reference only.

 

Changes to this page

This Terms & Conditions page was last amended on the date stated at the top of the policy. I’ll make changes to this page, as soon as one or more of my policies and disclaimer gets changed or in the case of advancing insights.
