1. Introduction & Acceptance
These Terms & Conditions (“Terms”) govern your use of monikadeneef.com (the “Website”) and the purchase of any programmes, services, or digital resources offered by Monika de Neef, a sole trader registered in New Zealand as Elevatia, trading as her personal brand Monika de Neef (“we”, “us”, or “our”).
By accessing the Website, subscribing to any mailing list, or purchasing a programme or service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase any offerings.
These Terms are governed by New Zealand law, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017. Where you are purchasing as a business, consumer guarantees under the Consumer Guarantees Act 1993 may not apply.
These Terms may be updated from time to time. The version current at the time of your purchase or engagement will apply to that transaction.
2. Our Services and Programmes
We only collect information that is necessary for the purposes described in this policy.
We offer premium mentoring and leadership development services for accomplished women in midlife. Our current offerings include:
- 1:1 mentoring programmes and engagements
- Group programmes and cohort experiences
- Digital resources, guides, and downloadable content
- Online courses and self-study materials
- Speaking and facilitation (subject to separate agreement)
Full details of current offerings, including scope, duration, and inclusions, are described on the relevant offer or sales page at the time of purchase. We reserve the right to modify, update, or discontinue any offering, provided that changes do not materially affect a programme you have already purchased and paid for.
3. Fees and Payment
Pricing
Fees for all programmes and services are displayed on the relevant offer page or communicated directly to you in writing prior to purchase. Prices are stated in United States Dollars (USD) or New Zealand Dollars (NZD) as indicated, and are inclusive of any applicable taxes unless otherwise stated.
We reserve the right to change pricing at any time. Any price change will not affect a programme or service you have already purchased at the agreed rate.
Payment processing
Payments are processed securely via Stripe. We do not store your credit card or banking details. By proceeding with a purchase, you agree to Stripe’s terms of service and authorise the applicable charge.
Payment plans
Where a payment plan is offered, this will be clearly stated on the offer page. The following conditions apply to all payment plans:
- You are responsible for ensuring sufficient funds are available on each scheduled payment date.
- A payment plan is a financial commitment for the full programme fee. Opting into a plan does not reduce your total obligation.
- If a payment fails, we will attempt to contact you. If the outstanding amount is not resolved within 14 days, we reserve the right to suspend your access to programme materials until payment is received.
- Continued non-payment may result in cancellation of access. Any fees paid to that point are non-refundable, and the outstanding balance remains due.
We reserve the right to apply an administration fee of up to 10% of the total programme fee to payment plan options, as disclosed on the offer page.
4. Refunds and Cancellations
Digital products and online programmes
Due to the nature of digital content, which may include immediate access to recordings, guides, frameworks, and course materials, all sales of digital products and online programmes are final and non-refundable once access has been granted.
By completing your purchase, you acknowledge that you are requesting immediate access to digital content and understand that this affects your ability to cancel under standard consumer protection provisions.
This policy does not limit any rights you may have under the Consumer Guarantees Act 1993 where a service is not provided with reasonable care and skill, or is materially different from its description.
1:1 mentoring programmes
If you have purchased a 1:1 mentoring programme or engagement:
After the cooling-off period, fees are non-refundable. If exceptional personal circumstances arise, please contact us to discuss. We will consider requests on a case-by-case basis, but are not obligated to provide a refund outside of the cooling-off period.
A cooling-off period of five (5) working days applies from the date the contract is entered into (the date of purchase confirmation). You may cancel for any reason within this period and receive a full refund, provided no sessions have commenced.
If you request that mentoring sessions begin within the cooling-off period and subsequently cancel, we reserve the right to charge for any sessions delivered on a proportionate basis.
Session cancellations and rescheduling
For individual sessions within a programme:
We will provide reasonable notice if we need to reschedule a session, and will work with you to find an alternative time.
You may reschedule a session with at least 48 hours’ notice via the booking system (Calendly). Cancellations with less than 48 hours’ notice will be forfeited and cannot be rescheduled.
Programme suspension
If you are unable to continue a 1:1 programme due to exceptional circumstances, you may request a suspension of up to four (4) weeks, subject to our written agreement. During any suspension period, payment obligations continue unless otherwise agreed. Sessions forfeited due to non-resumption after a suspension period are not refunded.
5. Programme Delivery
We will deliver all programmes and services with reasonable care, skill, and diligence. Sessions are delivered via video call (Zoom or equivalent) unless otherwise agreed. Recordings may be provided where agreed in advance.
You are responsible for ensuring you have a reliable internet connection and appropriate equipment for online sessions. We are not responsible for technical difficulties on your end that affect session delivery.
Programme materials are provided for your personal use only and are not to be shared, reproduced, or distributed. See Section 8 (Intellectual Property) for details.
6. Disclaimer and Results
Not a licensed health service
Our services are mentoring and leadership development in nature. We are not medical doctors, psychologists, psychotherapists, counsellors, or licensed mental health practitioners. Nothing in our programmes, resources, or communications constitutes medical, psychological, or therapeutic advice, and nothing should be construed as a substitute for professional health care.
If you are working with, or considering working with, a licensed health professional, we encourage you to discuss your participation in our programmes with them.
Individual results
We are committed to the quality and integrity of our work. However, the outcomes of mentoring and personal development work vary between individuals and depend on many factors, including your own effort, engagement, and circumstances. Nothing in our marketing materials constitutes a guarantee of specific results.
You acknowledge that we make no representations regarding financial returns, business outcomes, or personal transformation as a result of participating in our programmes, and that your results are your own responsibility.
Your wellbeing and responsibility
You take full responsibility for your decisions, choices, and actions as a result of engaging with our programmes and services. We encourage you to exercise your own discernment and, where appropriate, to seek independent professional advice in relation to decisions of significance.
7. Mentoring Confidentiality
We treat everything shared in our work together with the highest discretion. Information you share about your business affairs, personal circumstances, goals, and challenges is held in confidence and will not be disclosed to third parties without your consent. We will not voluntarily disclose that you are engaged in a mentoring relationship with us without your permission.
Confidentiality has the following standard limits: we are required to breach confidentiality if we have a genuine concern for your safety or the safety of others, or where we are required to by law.
You similarly agree to keep the content of our sessions, and any proprietary frameworks or materials shared, confidential and not to reproduce or disclose them without our prior written consent.
8. Intellectual Property
All content, materials, frameworks, tools, and resources provided as part of our programmes and services, including but not limited to the SEASONED Pathway, the Five Leadership Archetypes, the Five Awareness Lenses, Serendipity Compass methodology, written guides, recorded content, and visual assets are the intellectual property of Monika de Neef and are protected by New Zealand and international copyright law.
We grant you a limited, personal, non-exclusive, non-transferable licence to use programme materials for your own private development purposes only. This licence does not permit you to:
- Copy, reproduce, or distribute any programme materials in any form
- Share materials with third parties, whether for commercial gain or otherwise
- Use our frameworks or methodologies in your own commercial offerings without prior written agreement
- Record sessions or reproduce session content without our express written consent
Breach of these conditions may result in immediate termination of access to programmes without refund, and may give rise to legal action.
9. Limitation of Liability
To the fullest extent permitted by New Zealand law, our total liability to you in connection with any programme, service, or these Terms shall not exceed the total fees paid by you for the relevant programme or service.
We shall not be liable for any indirect, consequential, or special loss, including loss of profits, loss of business, loss of anticipated savings, or loss of data, arising from your participation in our programmes or use of our website.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, or our liability for fraud or fraudulent misrepresentation.
Where we are prevented from or delayed in performing our obligations due to circumstances outside our reasonable control (including illness, bereavement, natural disaster, or force majeure), we will notify you as soon as practicable and will work with you in good faith to reschedule or find an appropriate resolution. We will not be liable for losses arising from such circumstances.
10. Website Use
By accessing monikadeneef.com, you agree to use the Website lawfully and not to engage in any conduct that could harm the Website, its reputation, or other users.
The Website may contain links to third-party websites. We are not responsible for the content or practices of those sites. Links do not constitute an endorsement.
We make reasonable efforts to ensure the Website is accurate and up to date, but we do not guarantee that content is free from errors or omissions. We reserve the right to modify or remove content at any time without notice.
11. Privacy

In the course of delivering our services, we will process personal information in accordance with the NZ Privacy Act 2020 and as described in our Privacy & Cookies Policy.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
We are committed to resolving any concerns promptly and in good faith. If you have a concern, please contact us in the first instance before pursuing formal action.
13. Changes to This Terms
We may update these Terms from time to time. The effective date at the top of this document reflects the most recent revision. We will notify active clients of material changes by email. Your continued use of the Website or programmes following any update constitutes acceptance of the revised Terms.
